General Terms and Conditions
The full, formal version — so you know exactly where you stand. The headline stays the same as it's always been: unhappy within 14 days, one email, full refund.
Article 1 — Definitions
In these terms and conditions, the following definitions apply:
- Overlap: the entrepreneur identified in Article 2, supplier of the digital products offered on overlaptrips.com.
- Consumer: the natural person not acting for purposes related to their trade, business, craft or profession.
- Digital content: data produced and supplied in digital form, not supplied on a tangible medium.
- Destination pack: a pre-made digital travel-planning kit for a specific destination, delivered instantly after payment.
- Custom build: a digital travel-planning kit built for the customer's destination, dates and quiz results, delivered within 48 hours of Overlap receiving both quiz codes.
- Gift card: a digital voucher redeemable against products on overlaptrips.com.
- Withdrawal period: the period within which the consumer may exercise the statutory right of withdrawal.
- Lemon Squeezy: the merchant of record identified in the Lemon Squeezy Buyer Terms, which processes payments as authorized reseller of Overlap's products.
Article 2 — Identity of the entrepreneur
- Trade name: Overlap (sole proprietorship / eenmanszaak)
- Registered address: Oude Delft 60a, 2611 CD Delft, The Netherlands
- Email: hello@overlaptrips.com (we aim to respond within 2 business days)
- KVK number: 42107390
- VAT ID: [PENDING]
Article 3 — Applicability
- These terms and conditions apply to every offer by Overlap and to every distance contract concluded for Overlap's digital products.
- The text of these terms is made available on overlaptrips.com before any contract is concluded and can be stored on a durable medium.
- Payment, invoicing, VAT collection, refunds and chargebacks are handled by Lemon Squeezy as merchant of record. Lemon Squeezy's Buyer Terms apply to the payment transaction in addition to these terms. In the event of conflict, mandatory consumer law prevails, followed by these terms for everything concerning the product itself.
- Nothing in these terms limits any right the consumer has under mandatory law.
Article 4 — The offer
- Every offer states the essential characteristics of the product, the total price including VAT, and the manner of delivery.
- Offers contain complete and accurate information that allows the consumer to properly assess the offer. Obvious errors or mistakes in an offer do not bind Overlap.
- Launch prices (such as the €39 custom build price) may change; changes never affect contracts already concluded.
- Kits are delivered as web links. A current web browser and an internet connection are sufficient to use them; no account or special software is required.
Article 5 — The contract and the role of Lemon Squeezy
- The contract is concluded when the consumer completes checkout and Overlap (via Lemon Squeezy) confirms the order by email. By placing an order, the consumer confirms being legally capable of entering into the contract.
- The consumer purchases through Lemon Squeezy, which acts as merchant of record and authorized reseller. The product itself is supplied and licensed to the consumer by Overlap.
- Order confirmation, receipt and invoice are provided by email on a durable medium, including confirmation of any consent given under Article 6.
Article 6 — Right of withdrawal (digital content)
- For digital content not supplied on a tangible medium, the consumer has a statutory withdrawal period of 14 days from the day the contract is concluded, without giving reasons.
- Destination packs (instant delivery): by ticking the consent box at checkout, the consumer (a) expressly consents to immediate performance (instant delivery of the download link) and (b) acknowledges that they thereby lose the right of withdrawal once delivery has begun. Overlap confirms this consent in the order confirmation, and the download is made available only after this consent has been given.
- Custom builds: performance begins when Overlap starts producing the kit after receiving both quiz codes. The consumer may withdraw at any time before performance begins. Where the consumer has given the express consent and acknowledgment described in paragraph 2, the right of withdrawal lapses once the completed kit has been delivered.
- Gift cards: the withdrawal period is 14 days from purchase. The right of withdrawal lapses when the gift card is redeemed within that period.
- The loss of the statutory withdrawal right never limits the contractual refund guarantee in Article 8.
Article 7 — Exercising the right of withdrawal
- The consumer can withdraw by an unambiguous statement to hello@overlaptrips.com or by using the withdrawal form on overlaptrips.com. Use of the form is not mandatory.
- Overlap confirms receipt of a withdrawal without delay on a durable medium.
- Following withdrawal, Overlap instructs Lemon Squeezy without delay to refund using the same means of payment used for the original transaction, at no cost to the consumer. The refund is made within 14 days of the withdrawal.
Article 8 — Overlap refund guarantee
- Independently of the statutory right of withdrawal, Overlap offers a 14-day money-back guarantee: if the consumer is dissatisfied for any reason within 14 days of purchase, Overlap will refund the full purchase price on a single email to hello@overlaptrips.com. No justification is required, and the guarantee applies even if the kit has been downloaded, opened or used.
- Overlap instructs Lemon Squeezy to process the refund to the original payment method; refunds typically arrive within 5–10 business days of approval.
- This guarantee is a contractual commitment in addition to, and never instead of, the consumer's statutory rights.
Article 9 — Delivery and performance
- Destination packs are delivered instantly after payment as a link sent by email.
- Custom builds are delivered as links within 48 hours of Overlap receiving both quiz codes. If delivery is later than 48 hours, the consumer automatically receives a full refund and keeps the kit.
- The consumer is responsible for providing a correct email address. Overlap will re-send delivery links on request, free of charge.
Article 10 — Prices and payment
- All prices are in euros and include VAT.
- Payment is due at checkout via the payment methods offered by Lemon Squeezy.
- VAT on consumer sales is collected and remitted by Lemon Squeezy as merchant of record.
Article 11 — Gift cards
- Gift cards are digital, are delivered by email, and are redeemable only against products on overlaptrips.com. They cannot be exchanged for cash.
- Gift cards are valid for at least two years from the date of issue. The expiry date is stated on the gift card itself. Any remaining balance stays available until expiry.
- Gift cards may not be resold commercially. Overlap is not responsible for loss or theft of a gift card code after delivery, but will reasonably assist in re-issuing unredeemed codes.
- When a purchased product is gifted, the license in Article 12 transfers to the recipient.
Article 12 — License and intellectual property
- All kits, guides, packs and other content remain the intellectual property of Overlap.
- On delivery the consumer receives a non-exclusive, non-transferable license for personal, non-commercial use. Sharing the kit within the consumer's own travel group is expressly permitted.
- The following are not permitted without prior written consent: resale, sublicensing, public posting, redistribution outside the travel group, or use of the content to create competing products or to train automated systems.
- For gift purchases, the license vests in the gift recipient upon redemption.
Article 13 — Nature of the products and conformity
- Overlap supplies travel-planning information. Overlap does not book, sell or broker transport, accommodation, activities or insurance, and is not a travel agency, tour operator or package-travel organizer within the meaning of the EU Package Travel Directive.
- Kit contents are compiled from sources verified at the time of writing. Prices, opening hours and events at destinations change; the consumer should verify time-critical details before relying on them.
- The statutory conformity rules for digital content apply. If a kit does not conform to the contract, the consumer is entitled to the statutory remedies (supplementary performance, price reduction, or termination), in addition to the guarantee in Article 8. Overlap is liable for a lack of conformity that becomes apparent within two years of delivery; during the first year after delivery, the kit is presumed to have been non-conforming at delivery unless Overlap proves otherwise.
Article 14 — Liability
- Overlap is not liable for indirect or consequential damage, including costs of trips, bookings or activities arranged by the consumer with third parties.
- Overlap's total liability per contract is limited to the amount paid for the product concerned.
- The limitations in this article do not apply in the event of intent or gross negligence on the part of Overlap, and do not limit any liability that cannot be excluded or limited under mandatory law, nor any statutory consumer right.
Article 15 — Complaints
- Complaints about the performance of the contract must be submitted to hello@overlaptrips.com, described fully and clearly, within a reasonable time after the consumer discovers the issue.
- Overlap responds to complaints within 14 days of receipt. If a complaint requires a foreseeably longer processing time, Overlap will acknowledge it within 14 days and indicate when the consumer can expect a substantive answer.
- The consumer should give Overlap at least 4 weeks to resolve a complaint in mutual consultation before escalating.
Article 16 — Disputes and applicable law
- Contracts between Overlap and the consumer are governed by Dutch law.
- If the consumer resides in another EU member state, this choice of law does not deprive the consumer of the protection of mandatory provisions of the law of their country of residence.
- Disputes may be brought before the competent Dutch court. A consumer may also rely on the jurisdiction rules of mandatory (EU) law, including bringing proceedings in their country of residence where those rules allow. Consumers may additionally contact a recognized alternative dispute resolution entity; the European Commission publishes a list of such bodies per member state.
Article 17 — Amendments
- Overlap may amend these terms. Amendments are published on overlaptrips.com with a new effective date.
- The version in force at the time the contract was concluded applies to that contract. Amendments during the term of an offer will not be to the disadvantage of the consumer.
